Legal Information — ArdorFishing

1. Introduction and Acceptance of Terms

This Terms of Service Agreement (hereinafter referred to as the "Agreement") is a legal contract between you (hereinafter referred to as the "User") and the company operating the ArdorFishing platform (hereinafter referred to as the "Company," "we," "us"), accessible at ardorfishing.com, through the mobile application, and related services (hereinafter referred to as the "Platform").

By using the Platform, including its website, mobile application, API, notifications, and any other services, you agree to all the terms of this Agreement. If you do not agree with all the terms of the Agreement, you are not authorized to use the Platform.

The Company reserves the right to modify the terms of the Agreement at any time without prior notice. Continued use of the Platform after changes are made constitutes your acceptance of the new terms.

2. Right to Use

2.1 User Requirements

You may use the Platform only if:

You are at least 13 years of age; users between 13 and 16 years old must have guardian approval
You have the legal capacity to enter into legally binding contracts under applicable law
You are not a person prohibited from using such services under the laws of the Russian Federation and other applicable laws
You meet all legal requirements

2.2 License to Use

The Company grants you a personal, non-exclusive, non-transferable, time-limited license to access and use the Platform solely for purposes permitted by this Agreement. All other rights are reserved by the Company.

You may not:

Copy, modify, adapt, or translate the Platform or its content
Decompile, disassemble, or otherwise attempt to obtain the source code
Transfer or sublicense the license to third parties
Use the Platform for commercial purposes without written permission

3. Registration and Account

3.1 Registration Data

When registering, you agree to provide:

Accurate, complete, and current information about yourself
A valid email address
A phone number (if required)
Other information requested by the Platform

You bear full responsibility for the accuracy and currency of the information provided.

3.2 Account Security

You bear full responsibility for the confidentiality of your password and any activity occurring under your account. You agree to:

Immediately notify the Company of any unauthorized access to your account
Not provide your credentials to third parties
Not allow others to use your account
Not create additional accounts after they have been deactivated by the Company

The Company is not liable for unauthorized use of your account if it occurred due to your fault.

4. User-Generated Content

4.1 Responsibility for Content

You bear full responsibility for any content that you post, transmit, publish, upload, or otherwise make available on the Platform (hereinafter referred to as "User Content"), including:

Fishing information (geolocation, fish species, sizes)
Photos and videos
Text messages, comments, and reviews
Product and service offerings in the Marketplace

You warrant that:

You have all necessary rights to the User Content
The content does not infringe the rights of third parties
The content does not violate applicable law
The content complies with the Community Guidelines (Section 6)

4.2 License to Use Content

By posting User Content on the Platform, you grant the Company, its affiliates, partners, and licensees:

Unlimited, worldwide, perpetual rights to use your name, likeness, and voice
The right to reproduce, modify, distribute, and publicly display the content
The right to use the content for commercial purposes, including advertising and sponsored content
The right to use information about your actions and activity on the Platform

You grant these rights without any monetary or other compensation.

4.3 Content Removal

The Company has the right, at its discretion, to:

Remove, block, or hide any User Content that violates the Agreement
Restrict the visibility of content in public sections of the Platform (feeds, rankings, maps)
Deactivate an account for repeated violations

You will be notified of the reasons for content removal via email.

5. Marketplace and Commercial Activities

5.1 Sellers and Product Offerings

If you use Marketplace features to offer goods or services:

You warrant ownership or exclusive rights to the offered goods/services
You agree to provide accurate information about goods (description, price, specifications)
You bear full responsibility for the quality and conformity of goods to their description
You agree to comply with all applicable laws, including consumer protection legislation

5.2 Payments and Financial Transactions

The Company does not directly participate in financial transactions between buyers and sellers
The Company provides payment processing and communication services between parties
You agree to use only legal payment methods
The Company is not liable for fraud by other users
All disputes regarding the quality of goods and services must be resolved directly between the parties

5.3 Platform Fees

The Company may charge fees for using Marketplace services. The fee amount will be specified during seller registration. The Company reserves the right to change fee amounts with prior notice.

6. Community Guidelines and Rules of Conduct

6.1 Prohibited Content

You may not post content that:

Violates the law:

Is related to illegal, poaching, or out-of-season fishing
Contains offerings of illegal goods or services
Infringes copyrights, patents, or other intellectual property rights

Is offensive:

Contains insults, threats, intimidation, or harassment
Contains discriminatory content based on race, nationality, religion, gender, or sexual orientation
Contains hate speech, violence, or extremist content
Contains nudity, pornographic, or sexually explicit content

Is fraudulent:

Contains pyramid scheme offers, fraudulent schemes, or phishing
Contains false or misleading information
Impersonates another user or organization

Is spam:

Contains repetitive messages or unwanted advertising
Contains links to malicious content or viruses

Violates platform policies:

Contains political content unrelated to fishing
Contains images of weapons in an unjustified context
Contains AI-generated content intended to demean or insult users
Contains coordinates that identify private fishing spots without the owner's consent

6.2 Rules of Interaction

Treat other anglers and Platform users with respect
Do not stalk or harass other users
Assume good intentions in conversations, but respect others' wishes not to receive advice
Help the community through sharing experience and knowledge
If a user has offended you, use the block and report functions rather than continuing the conflict

6.3 Fishing Information

You bear full responsibility for obtaining necessary fishing permits and licenses
Information about fishing locations must be accurate and comply with applicable law
You may not publish information about fishing locations on private property without the owners' consent
The Company has the right to restrict the visibility of data that does not meet accuracy standards (missing coordinates, implausible sizes)

7. Personal Data Processing and Privacy

7.1 Data Collection

The Company collects and processes the following personal data:

Information you provide during registration
Content you post on the Platform
Geolocation data (if you have granted permission)
Information about your use of the Platform and interactions with other users
Technical data (IP address, browser, device)

7.2 Data Use

The Company may use personal data to:

Provide Platform services
Improve functionality and content
Display targeted advertising and recommendations
Comply with legal requirements
Protect the security of the Platform and users

7.3 Data Protection

The Company undertakes to comply with the requirements of Federal Law No. 152-FZ "On Personal Data" and other applicable laws of the Russian Federation, as well as GDPR provisions for EU users.

The Company has implemented technical and organizational measures to protect personal data from unauthorized access, alteration, disclosure, and destruction.

7.4 User Rights

You have the right to:

Access your personal data and fishing logs
Receive a copy of your data in a portable format for transfer to another service
Request correction of inaccurate data
Request deletion of your data (subject to legal requirements)
Withdraw consent to data processing at any time

8. Disclaimer of Warranties and Limitation of Liability

8.1 "As Is"

The Platform is provided on an "as is" basis without warranties. The Company does not guarantee:

Error-free operation of the Platform
Availability of the Platform at any time
Accuracy of information posted by users
Legality, quality, or safety of User Content

8.2 Limitation of Liability

The Company is not liable for:

Use or misuse of equipment during fishing
Interactions between users and third parties
Delays or inability to use the Platform
Any information, software, goods, or services obtained through the Platform
Losses caused by use or inability to use the Platform, even if the Company was notified of the possibility of such losses

The Company is not liable to you for:

Your fishing activities that are the source of content
Injuries or losses related to your fishing
Disputes with other users
Any actions taken based on information from the Platform

8.3 Maximum Liability

The Company's maximum liability to you is limited to the amount you actually paid for using the Platform during the last 12 months, or 100 rubles if you have not made any payments.

9. Indemnification

You agree to defend, indemnify, and hold harmless the Company, its officers, employees, and agents from:

Any claims, demands, losses, and expenses (including legal fees)
Your violation of the Agreement
Your violation of applicable law
Your infringement of third-party rights
Your use of the Platform in a manner that violates the Agreement

10. Prohibited Activities

You may not use the Platform to:

Violate laws or the rights of others
Hack, distribute viruses, or conduct other computer attacks
Use bots, scripts, or automated means to access the Platform
Create derivative works of the Platform without permission
Collect or track information about other users
Engage in spam, phishing, or social engineering
Use the Platform for competitive purposes or to create a competing service
Violate the terms of this Agreement

The Company has the right to immediately deactivate your account for violation of these terms.

11. Termination of Use

11.1 Termination by User

You may terminate your use of the Platform and delete your account at any time through profile settings. Upon account deletion:

Your account and content will be deactivated
You will lose access to your data stored on the Platform
Some information may be retained in accordance with legal requirements

11.2 Termination by Company

The Company has the right at any time to suspend or terminate your access to the Platform:

For violation of the Agreement
For security reasons
For unreasonable behavior
For reasons arising from legislation

Upon termination, you will receive an email notification explaining the reasons.

11.3 Effect of Termination

Upon termination:

Your license to use the Platform expires
You must immediately cease using the Platform
Provisions of the Agreement that by their nature should continue to apply remain in effect (limitation of liability, indemnification, etc.)

12. Direct Liability Between Users

The Company acts as a neutral intermediary providing a technology platform for interaction between users. The Company is not liable for:

Interactions, transactions, or disputes between users
The accuracy, safety, or legality of information posted by other users
The behavior of other users
Verification of user authenticity or qualifications

In the event of a conflict between users, please use the built-in complaint system or contact the Company for support.

13. Intellectual Property

13.1 Platform Ownership

All materials on the Platform, including text, graphics, logos, images, audio, video, software, and design, are the property of the Company or its licensors and are protected by intellectual property law.

You may not copy, reproduce, modify, distribute, or use these materials without written permission from the Company.

13.2 User Content

You retain ownership of User Content that you create. However, by posting content on the Platform, you grant the Company a license to use it (see Section 4.2).

14. Advertising and Sponsorship

The Platform may contain advertising, sponsored content, and other promotional materials. The Company does not guarantee the accuracy of advertisements and is not liable for interactions between you and advertisers.

You may not disguise or mask commercial content as editorial content unless expressly permitted by Platform rules.

15. Hyperlinks and Third-Party Sites

The Platform may contain links to third-party websites. The Company is not liable for:

Content of third-party sites
Accuracy or legality of information on those sites
Data collection by third-party sites
Interactions between you and third-party sites

Use of third-party sites is governed by their own terms of use and privacy policies.

16. Moderation and Support

16.1 Moderation System

The Company maintains a moderation system to:

Remove content that violates the Agreement
Protect Platform security
Comply with legal requirements

Moderation may be conducted automatically or manually. The Company strives to be fair, but errors may occur.

16.2 Complaints and Appeals

If your content has been removed or your account has been deactivated, you may:

Contact the Company within 30 days
Provide additional information or evidence
Request a review of the decision

The Company will review your complaint and communicate its decision within 15 business days.

17. Amendment of Agreement

The Company may amend the terms of the Agreement at any time. Changes take effect immediately upon posting on the Platform.

Your continued use of the Platform after changes constitutes your acceptance of the new terms. We recommend periodically reviewing the Agreement for changes.

18. Force Majeure

The Company is not liable for delays or failure to perform obligations caused by force majeure circumstances, including (but not limited to):

Natural disasters
War, terrorism, or civil unrest
Pandemics and emergencies
Internet or power outages
Government actions
Other events beyond the Company's reasonable control

19. Governing Law and Dispute Resolution

19.1 Governing Law

This Agreement is governed by the laws of the Russian Federation, in particular:

The Civil Code of the Russian Federation
Federal Law No. 152-FZ "On Personal Data"
The Consumer Protection Law of the Russian Federation
Other applicable legislation of the Russian Federation

19.2 Dispute Resolution

Pre-trial Procedure:

Before filing a lawsuit, you agree to send a written claim to the Company. The Company will review the claim within 30 days.

Jurisdiction:

Any court disputes shall be heard by a court in accordance with the Civil Procedure Code of the Russian Federation. If you are a consumer, you may apply to the court at your place of residence.

Alternative Resolution:

The parties may agree to use mediation, arbitration, or other alternative dispute resolution methods.

20. Export and Sanctions

You agree to use the Platform in accordance with applicable export and sanctions laws, including sanctions of the Russian Federation and other countries.

You may not use the Platform if:

You are on sanctions lists
You are located in a country subject to sanctions
Your activities fall under export control restrictions
